Terms and conditions of sale

These sales terms govern the conclusion and processing of purchases and bookings with MWS Physio (physiotherapy services, MWS Score, course/training offers, products/assistive devices, vouchers). They supplement our General Terms and Conditions (GTC) and apply to all transactions on site, by phone, by e‑mail and online.

 

1. Scope and definitions

  • Provider: MWS Physio, Landstrasse 55, 5430 Wettingen, Switzerland

  • Customers: patients, self‑paying clients, companies/institutions

  • Services: physiotherapy, MWS Score, courses/trainings, digital content

  • Products: medical aids, training equipment/accessories, vouchers

  • Contract formation: a contract is concluded by booking, ordering or purchase

 

2. Offer, prices and contract formation

  • Offer: non‑binding; errors, printing and transmission mistakes reserved

  • Prices: in CHF; including/excluding VAT as indicated. Prices may change at any time; confirmed bookings are excluded

  • Contract formation:

    • Online: by clicking “place order/book with payment obligation”

    • On site / Phone / E‑mail: by appointment or order confirmation

  • Availability: appointments/products only while available

  • Cost approval: for insured services subject to coverage/approval by the cost bearer

 

3. Services: physiotherapy, MWS Score, courses/training

  • Physiotherapy: possible with medical prescription or as self‑pay; no guarantee of success

  • MWS Score: performed according to the service description; optionally bookable as a package

  • Courses/training: carried out as described in the announcement (duration, contents, minimum participant number)

  • Scope of services: defined in the offer/confirmation; medically or organisationally necessary adjustments possible at any time

 

4. Appointments, cancellations, delays, no‑shows

  • Booking channels: phone, e‑mail, online system

  • Free cancellation/rescheduling: up to 48 hours before the start

  • Late cancellation/no‑show: full charge of the treatment unit/course fee regardless of reason

  • Exceptions: in case of verifiable emergency, acute illness or accident (proof e.g., medical certificate)

  • Delay: shortens treatment time; full fee remains due

  • Course cancellation by provider: refund of course fee; further claims excluded

 

5. Payment, billing, insurance

  • Payment methods: cash, common cards, invoice (subject to credit check), online payment

  • Due date: immediately after service; invoices within 10 days

  • Insurance billing:

    • With medical prescription generally via KVG/UVG/supplementary insurance; deductibles/franchise borne by customers

    • If cost approval is absent or refused: total costs borne by the customer

  • Arrears: reminder fees and collection costs charged to the customer

  • Discounts/promotions: not combinable unless stated otherwise

 

6. Packages, subscriptions, vouchers, promotion codes

  • Packages:

    • Payment in advance

    • Validity: 12 months from purchase (unused units expire)

    • Non‑transferable; commercial resale prohibited

    • Refund excluded except for medically justified termination (pro rata, minus discounts/admin fee)

  • Subscriptions/memberships: term, renewal, suspension as per contract; pro rata refunds excluded

  • Vouchers:

    • Validity: 24 months from issue (unless otherwise stated)

    • No cash payout (unless legally required)

    • No liability for loss/theft

  • Promotion codes: one code per order; conditions per promotion

 

7. Product sales: delivery, collection, inspection, returns, warranty

  • Delivery area: Switzerland/Liechtenstein

  • Delivery time/costs: as stated in checkout/confirmation; partial deliveries possible

  • Collection: possible after notification (click & collect)

  • Transfer of risk: on handover to the customer or carrier

  • Inspection duty: report visible transport damage immediately to the carrier and notify us within 48 hours

  • Returns:

    • Within 14 days, only in original packaging, unused, complete; return shipping costs borne by customer

    • Excluded: hygiene/sealed items after opening, special orders, digital content

    • Refund as store credit; handling fee possible

  • Warranty:

    • 2 years for new products, 1 year for used goods (unless otherwise stated)

    • Defect notification within a reasonable time with documentation

    • Remedies: repair, replacement or price reduction at provider’s choice; further claims excluded as far as legally permitted

8. Liability, warranty for services, force majeure

  • Services: duty of care; no guarantee of success

  • Liability limitation: only for direct damage caused by intent/gross negligence; no liability for indirect damages, consequential loss, loss of profit, training/application errors outside our control

  • Valuables: no liability for wardrobe/valuables

  • Duty to cooperate: complete and truthful disclosure of health status; risks from incomplete/incorrect information lie with the customer

  • Force majeure: in events beyond our control (e.g., epidemics, official orders, power/network failures, extreme weather) we will reschedule services appropriately; liability for delays is excluded

9. Digital content, rights, use, data protection

  • Digital content: personal, non‑exclusive, non‑transferable license; no sharing, publication or commercial use

  • Copyright/IP: all content (texts, graphics, trademarks, MWS Score) is protected; any use beyond personal purposes requires our consent

  • Data protection: processing of personal data in accordance with our privacy policy (revDSG)

  • Electronic communication: e‑mail/online contact at the customer’s risk; for confidential matters we recommend phone or in‑person appointment

 

10. Final provisions

  • Partial invalidity: invalid provisions do not affect the validity of the remainder; replacement by economically equivalent regulation

  • Changes: sales terms may be amended at any time; the version published at the time of purchase/booking applies

  • Language/priority: the German version is authoritative; individual agreements take precedence

  • Jurisdiction/law: Swiss law exclusively; place of jurisdiction Aargau, Switzerland
